As Arbitrator
Sofía Klot sits as arbitrator in international commercial arbitrations conducted in English and Spanish. She brings to the tribunal more than 13 years as counsel at leading international arbitration firms, earlier years as a corporate lawyer, experience supporting arbitral tribunals from within as secretary, and formal training in the conduct of ICC arbitrations.
She has particular expertise in commercial disputes in the technology, renewables, energy, infrastructure and construction sectors and in regulated industries.
Her approach
Sofía knows the file inside out, comes to hearings and deliberations prepared and does not decide a point without giving both parties the opportunity to address it. A professor of international arbitration, she is attentive to differences in legal culture and will adapt the usual practice on witness evidence, cross-examination, or document production where the parties prefer it, as long as fairness and efficiency are preserved. She is firm where firmness is required: thirteen years as counsel taught her the cost of a proceeding allowed to drift, and she applies the agreed rules and timetable evenly. She is attuned to the pressures that counsel work under, and keeps the proceeding to what the dispute actually requires.
Her experience includes:
As arbitrator
Sole arbitrator in an ICC expedited arbitration between a development bank and a supplier concerning a contract for communication consultancy services.
Co-arbitrator in an ICC arbitration between Mexican parties, seated in Mexico, concerning a contract for software engineering services.
Co-arbitrator in an ICC arbitration between Mexican companies, seated in Mexico, concerning the construction of a data center.
As tribunal assistant and secretary
Assistant to the Tribunal in an ICSID arbitration against Mexico concerning lithium mining concessions, and to the President of the Consolidation Tribunal in the related consolidation proceedings.
Assistant to the Tribunal in an ICSID arbitration against Peru concerning a telecommunications infrastructure concession.
Administrative Secretary in ICC arbitrations concerning the design and construction of an international airport for a Latin American State, photovoltaic power purchase agreements between Spanish parties, the supply and maintenance of a power generation turbine in a bilingual proceeding seated in Montevideo, and an automotive industry dispute between German and Russian parties seated in Switzerland.
